Terms of Service.

By submitting an application for, accepting, or participating in the Can Silvestre Artist Residency, the Artist agrees to be bound by the present Terms of Service.

1. Commitment to the Environment

The Artist agrees to act responsibly and respectfully toward the natural surroundings of Can Silvestre, acknowledging that the residency takes place in a rural environment rich in ecological value. The Artist will refrain from damaging, removing, or disturbing any flora, fauna, water sources, or environmental elements. Any action that threatens the ecosystem may result in early termination of the residency.

2. Image Use & Documentation

The Artist authorizes the Organization to document and use their image (photography, video, voice) as well as documentation of their creative process. This material may be used for archival, promotional, cultural, and communication purposes across printed, digital, and audiovisual media. This authorization is given free of charge, unlimited in time and territory, and does not transfer ownership of any artworks.

3. Community Conduct & Respect

The Artist agrees to maintain a respectful, considerate, and collaborative attitude toward the Organization, staff, fellow residents, and any collaborators or visitors. Can Silvestre is a shared creative environment, and the Artist is expected to contribute to a harmonious, safe, and welcoming atmosphere.

4. Participation in Residency Activities

The Artist agrees to participate in any public events, open studios, talks, workshops, studio visits, or other activities included in the residency program, as previously discussed with the Organization. The Artist also agrees to follow the reasonable timelines and commitments related to their creative work during their stay.


5. Liability Waiver

The Artist acknowledges that participation in the residency is entirely voluntary and understands that the residency involves living and working in shared spaces and engaging in artistic, domestic, and outdoor activities that may carry inherent risks.

To the fullest extent permitted by law, the Artist agrees to assume full responsibility for their personal safety, health, and well-being throughout the duration of the residency and hereby releases, waives, and discharges the Organization, its directors, staff, collaborators, volunteers, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to any accident, injury (including personal injury or illness), loss, theft, or damage to personal property occurring during the residency period, whether on or off the premises.

The Organization shall not be held responsible for the loss, theft, or damage of the Artist’s personal belongings under any circumstances. Artists are encouraged to secure appropriate personal, health, travel, and property insurance prior to arrival.

This waiver shall apply to all claims except in cases of gross negligence or willful misconduct on the part of the Organization, as determined by applicable law.

6. Intellectual Property

All artworks produced during the residency remain the sole property of the Artist. The Organization does not claim ownership of the artworks. However, the Artist grants permission for the Organization to document and use images or recordings of the artworks for archival, cultural, and promotional purposes, always acknowledging the Artist’s authorship.

7. House Rules

The Artist agrees to carefully read, respect, and follow the Can Silvestre House Rules, which are provided in the Welcome Guide. These rules are essential for maintaining a safe, respectful, and productive environment for all residents. Failure to comply with the House Rules may result in warnings or, in serious cases, early termination of the residency.

8. Payments & Refund Policy

Full payment is required to confirm participation in the residency or any activity at Can Silvestre.

If a participant needs to request a reimbursement, the following cancellation terms apply:

  • Cancellations made at least 30 days prior to the start date are eligible for a 50% refund, minus any applicable administrative costs.

  • Cancellations made within 30 days of the activity or residency start date are non-refundable.

These terms are established to ensure fairness and to protect the financial sustainability and planning of the residency program.

9. Cancellation or Early Departure

If the Artist decides to leave the residency before the agreed dates, they must notify the Organization in advance. The Organization reserves the right to cancel participation if the Artist violates the terms of this agreement or the House Rules.

10. Dispute Resolution

Any disagreements between the parties will be addressed through direct dialogue or informal mediation, aiming to preserve respect and the integrity of the shared experience.
